A Suffolk man was sentenced Monday to about a year to serve on charges of obstruction of justice, trespassing and making threats over the public airways.

Louis Dell Highsmith, 72, entered Alford pleas, said prosecutor Tom Shaia. Entering an Alford plea means the defendant does not admit guilt but acknowledges the prosecution has enough evidence for a conviction.

According to court documents, Highsmith sent a fax to Suffolk General District Court and to a local attorney’s office last April 7. The fax included such phrases as “bombs away,” “man your battle stations,” “incoming incoming incoming” and “drop Big Bertha!”

That day, bail had been set for Highsmith on previous charges of trespassing and failure to appear on the trespassing charge. Highsmith had been seen on March 22 on a property where he had been notified not to appear.

Also according to court documents, Highsmith made a threat against a judge while in jail after being arrested on the bomb threat charge.

When a jail officer and a nurse engaged him in conversation, he began ranting and then said, “I caught the judge committing fraud and that’s the reason I’m here, and when I get out I will kill him,” according to the court documents.

Highsmith was sentenced to four months to serve on each of the three charges. As he will get credit for time served, he will likely be released from jail this week, if he hasn’t been already, Shaia said.

Shaia said Highsmith will receive treatment for mental illness through the Veterans

Administration and the Western Tidewater Community Services Board.

Highsmith will also be on active probation for three years and good behavior for four years.
