Former priest’s name cleared

A former priest in Suffolk has had his record cleared after an expungement hearing in Suffolk Circuit Court last week.
Piotr Bialkowski, the former priest at St. Mary of the Presentation Catholic Church and at Church of the Good Shepherd in Smithfield, was charged in 2011 with domestic assault. Bialkowski, 36 at the time of his arrest in December 2011, was accused of assaulting the mother of his child on Nov. 25 of that year.
He was found not guilty in Juvenile and Domestic Relations Court and, on Wednesday last week, his record was expunged.
“Because he met the statutory requirements, we didn’t have an objection,” prosecutor James Wiser said Monday.
To have a criminal record expunged, the petitioner must have been found not guilty, or the charge must have been dismissed or dropped in some way. The court must also find the continued existence and possible dissemination of information relating to the charges could cause a “manifest injustice.”
The case was heard before Judge Robert H. Sandwich Jr. Though Sandwich said Bialkowski officiated at his marriage, he said it was OK for him to hear the case, because the commonwealth had no objection.
